    Terms of service for Meridian Care

    The Service User

    The person for whom the service will be provided.

    The Provider

    Meridian Care; who will be providing the service that is being contracted.

    The Service to be Provided

    The service/services to be provided are as per Care plan agreed with me or on my behalf.

    Times agreed are subject to variation by 30 minutes either way.

    Fees Payable

    • Cost of Service: As per attached Charge-out Rates Schedule
    • The Charge Rates will be reviewed from time to time and any changes notified to you in advance in writing
    • The Service User will be invoiced on a four weekly basis
    • If invoices remain unpaid after 14 days, unless otherwise agreed or in exceptional circumstances, interest will be charged at 10% p.a. on the unpaid balance
    • The Guarantor will be responsible for paying the Service User's fees from the Service User's funds and assets
    • Bank Holidays are charged at 1½ times normal rates
    • Christmas Day, Boxing Day and New Year's Day are charged at 2 times the normal rates
    • If a member of Meridian Care enters into the Service User's direct employment as a result of being introduced directly or indirectly by Meridian Care, a one-off fee will be charged by way of compensation. This fee will be £1000.00

    Review of the Service

    • The Service User may change the service that was requested at any time by contacting one of the Provider's Managers or Care Co-coordinators
    • This change will be documented on the Care plan and signed
    • The Provider's Manager or Care Co-coordinator will arrange for periodic reviews of the service to ensure that the level of service provided is sufficient and that we have maintained our normal high levels of service

    Cancellation or Withdrawal of the Service

    • The Service User may cancel any individual calls by giving 24 hours notice
    • If less than 24 hours notice is given, the Service User will be charged for the call as per the Careplan, unless in exceptional circumstances
    • The Service User must give 5 days notice to terminate the contract, unless in exceptional circumstances
    • The Contract will be automatically terminated if the Service User is admitted into hospital for more than 4 weeks
    • Meridian Care may give notice to withdraw the service for the non payment of fees, or feels that the Company is unable to provide the degree of care and attention required, or that the Service User's behaviour may be seriously detrimental to the welfare of the Company's staff

    Insurance

    • Meridian Care will be responsible for having the appropriate levels of insurance cover to provide the service in relation to Employer's Liability and Public Liability
    • The Provider will replace or compensate for any accidental damage caused by the provider's staff

    Health and Safety

    • The Provider will ensure that all health and safety regulations relating to the Service User and its staff will be abided by as per the Company's policy and the Law
    • The Service User will ensure that the equipment provided by them for the Provider's staff to use are serviced regularly and safe to use
    • The Service User will ensure that the environment where the service has to be provided is safe

    Staff Supervision

    • Meridian Care will take all reasonable actions to ensure that all staff employed will be sufficiently skilled to provide the service requested
    • The Service User will notify Meridian Care in advance of any special skills that are required of the staff
    • On occasions of staff holidays and sickness the Provider will endeavour to provide alternate staff
    • A copy of the Company's complaints procedure is provided herewith

    Service User Guide

    A copy of Meridian Care's Service User Guide is provided herewith. It provides all the relevant information of the Company and our services that you may require. It includes all the information required under the Domiciliary Care Agencies Regulations 2002.
